Home cultivation of cannabis is a third-degree felony in Florida under Florida Statute 893.13 — regardless of quantity, regardless of medical patient status. There are no exceptions.
Florida has one of the largest medical marijuana programs in the country with over 900,000 registered patients, but patients cannot grow their own medicine at home. All cannabis must be purchased from licensed Medical Marijuana Treatment Centers (MMTCs).
What Just Happened: SB 776 (2026)
SB 776 was the most recent home grow bill filed in the Florida legislature. It died in the Senate Health Policy Committee on March 13, 2026, without receiving a floor vote. This followed SB 546 in 2025, which also died in committee — two consecutive sessions with zero legislative progress on home grow.
What Happened: 2026 Ballot Initiative
A citizen-led ballot initiative attempted to bring home grow directly to Florida voters in 2026. The initiative failed to collect enough valid signatures — 793,000 were gathered against the 880,000 required. It will not appear on the 2026 ballot.
What’s Next: November 2026 Elections
The November 2026 elections are the next major opportunity. Florida will elect a new governor and fill all 140 legislative seats. The composition of the new legislature — and the priorities of the incoming governor — will determine whether a 2027 home grow bill has any chance of advancing. No bill has been filed yet for the 2027 session as of May 2026.
